Did you know that “gay panic” or “transgender panic” is an actual legal defense? What is it? This is when, for instance, a transgendered male picks up a straight male and pretends to be female without the straight male’s knowledge and then when the straight male finds out the transsexual is actually male, he panics and harms the transsexual.
This is exactly what happened in Fresno, CA and the transsexual man was stabbed 20 times to death. And what did the straight male get for a sentence? 4 years in jail! Yes it is wrong to misrepresent yourself and it’s not fair to straights if you are gay and don’t tell them. A four-year jail sentence imposed on a Fresno, Calf., man for killing a transgender woman has enraged local advocates for gay, lesbian, bisexual and transgender rights.
According to the Associated Press (AP), Estanislao Martinez admitted to stabbing the victim, identified as Joel Robles, 20 times in August 2004. Martinez had brought Robles home for the evening and then murdered his guest after discovering Robles was biologically male.
Martinez was sentenced on Wednesday in Fresno County Superior Court after his lawyers used a strategy known as “transgender panic” or “gay panic.”
“I am extremely troubled that this sentence sends a message that murder is not murder if the victim is transgender,” Geoffrey Kors, executive director of Equality California, said in a prepared statement.
Is it okay to kill someone if they simply just misrepresent themselves? What if a black man was wearing a mask and a white woman thought he was a white man. After they had sex and she found out his real identity, would that give her cause to KILL him? Of course not! So why is it acceptable in the gay community? Are we that expendible? We are human too! I’m sick of being gay just being one big cosmic joke. People say that we can “choose” our lifestyle. Who the hell would choose this????? This is just completely disturbing and once again the gays are trampled on. We’ve made progress in the last 20-30 years but we have a long way to go, my friends.
