Did you know that “gay panic” or “transgender panic” is an actual legal defense? What is it? This is when, for instance, a transgendered male picks up a straight male and pretends to be female without the straight male’s knowledge and then when the straight male finds out the transsexual is actually male, he panics and harms the transsexual.

This is exactly what happened in Fresno, CA and the transsexual man was stabbed 20 times to death. And what did the straight male get for a sentence? 4 years in jail! Yes it is wrong to misrepresent yourself and it’s not fair to straights if you are gay and don’t tell them. However 4 years in jail because you’ve killed someone in a fit of homophobia is completely unfair! Read more about the article:

A four-year jail sentence imposed on a Fresno, Calf., man for killing a transgender woman has enraged local advocates for gay, lesbian, bisexual and transgender rights.

According to the Associated Press (AP), Estanislao Martinez admitted to stabbing the victim, identified as Joel Robles, 20 times in August 2004. Martinez had brought Robles home for the evening and then murdered his guest after discovering Robles was biologically male.

Martinez was sentenced on Wednesday in Fresno County Superior Court after his lawyers used a strategy known as “transgender panic” or “gay panic.”

“I am extremely troubled that this sentence sends a message that murder is not murder if the victim is transgender,” Geoffrey Kors, executive director of Equality California, said in a prepared statement.

Is it okay to kill someone if they simply just misrepresent themselves? What if a black man was wearing a mask and a white woman thought he was a white man. After they had sex and she found out his real identity, would that give her cause to KILL him? Of course not! So why is it acceptable in the gay community? Are we that expendible? We are human too! I’m sick of being gay just being one big cosmic joke. People say that we can “choose” our lifestyle. Who the hell would choose this????? This is just completely disturbing and once again the gays are trampled on. We’ve made progress in the last 20-30 years but we have a long way to go, my friends.

Alright, alright, I know we’re having two non-porn posts in a row and we will soon get back to the awesome smut that we love looking at, but a major pro-gay milestone was made today and it’s very worthy of a mention.

An appeals court ruled today that an anti-Jerry Falwell site with a domain name that misspells his name to promote gay and lesbian causes may stay online. Fallwell.com is run by a gay man who has a strong devotion to God and explains why Jerry Falwell is “completely wrong when he says gays and lesbian people are sinning and can change”.

It’s actually a very interesting site with some great arguments against the fundamentalists who hate gays. It goes on to explain why The Bible is misinterpreted in it’s position about homosexuality and God loves us all no matter what our sexual orientation is. It’s great reading, especially the “Bible verses that even fundamentalists don’t take literally”. So if they don’t take these verses literally, then why do they take the alleged verses about homosexuality literally?

Anyway the site has been ruled by the courts to be able to stay online and use a misspelling of Jerry Falwell’s name. Finally, someone has some fairness when it comes to gay rights.

Well I had a ray of hope this morning when reading that headline. I thought perhaps there was a breakthrough with religious zealots who speak out against homosexuality but once again, the gay community has been overlooked and they are only speaking of radical Islamics. I do agree that radical Islamics should be considered unacceptable under the law, but they should extend this new law to preachers that condemn homosexuality because that leads to hatred too! I know that gays and lesbians have made lots of progress in the last 20-30 years but we still have a long way to go, baby!

LONDON (Reuters) – Britain published guidelines on Wednesday for barring foreigners the government believes inspire terrorism, as part of a broad crackdown on Islamist preachers after last month’s deadly bombings in London.

In a move that sparked sharp criticism from civil rights groups, the government released a list of unacceptable activities which would trigger deportation or an entry ban.

“The terrorist threat facing the UK remains real and significant and it is right that the government and law enforcement agencies do everything possible to counter it,” said Interior Minister Charles Clarke.

“That includes tackling those who seek to foster hatred or promote terrorism, sending a strong message that they are not welcome in the UK.”

Two waves of bomb attacks in London which killed 52 commuters last month prompted a series of new anti-terrorism measures and British Prime Minister Tony Blair says the “rules of the game are changing.”

The list of activities deemed unacceptable, which covers non-UK citizens in Britain or abroad, includes expressing opinions which “foment, justify or glorify terrorist violence” or seeking to provoke others to commit terrorist acts.

The government said the guidelines, which take immediate effect, applied to views conveyed through written or published material, including Web sites, as well as public speaking.

“The proposals do nothing but unleash further Islamophobia in British society,” said the Islamic Human Rights Commission, saying the plans represented a “criminalisation of thought.”

Britain is home to 1.6 million Muslims, just under three percent of the population. About two thirds of British Muslims hail from the Indian subcontinent.

Some experts say Blair is belatedly responding to criticism that Britain’s tradition of granting asylum to Middle East dissidents, a practice that earned London the tag “Londonistan,” has helped foster a dangerously radical Islamist scene.

“There’s an element of this which is to prove to the British public that the government is taking it very seriously,” said Michael Clarke of London’s Center for Defense Studies.

He said the criteria would not stop determined bombers and that he expected deportees to challenge the new plans in court.

Rights groups opposed the review of government powers.

“The vagueness and breadth of the definition of “unacceptable behavior” and “terrorism” can lead to further injustice and risk further undermining human rights protection in the UK,” said Halya Gowan of Amnesty International.

Civil rights group Liberty attacked any move that would lead to suspects being sent to countries with a record of torture.

Earlier this month, Britain pledged to deport 10 people, including the suspected spiritual leader of al Qaeda in Europe, Jordanian national Abu Qatada.

Britain is working on agreements with a number of countries which it says will protect any deportees from ill treatment.

SAN FRANCISCO — A San Francisco man who says he was devastated after he was identified as gay on a national Spanish-language radio show will be paid $270,000 by Univision Radio, an arbitrator has ruled.

Roberto Hernandez, 45, was driving to work in 2002 when he received a phone call from a man who said that he met Hernandez at a San Francisco gay bar. The caller then announced that the conversation was being broadcast live on the “Raul Brindis and Pepito Show,” based in Houston.

Hernandez worked for the local station that broadcast the show, and sold advertising for the program. He said he was so depressed by the incident that he could no longer work.

I’m not one to advocate living in the closet, but I don’t advocate outing other people either. I think one’s coming out should be up to them and when they’re ready. It’s a shame that other people are too stupid to understand that it’s a personal issue. Since I was the victim of a forced outing myself (my sister told my parents when I told her in confidence!) I know the humiliation and embarrassment this guy must feel. Hmm….maybe I should sue my sister for $270,000??

But seriously, the show was so good, it’s a bummer that it’s over already. I was so disappointed that Brian and Justin didn’t get married!! And I really wanted Ted and Emmett to get together as a couple. Oh well, life goes on…

So if you’re in queer show withdrawl (and don’t say watch Queer Eye For The Straight Guy, it’s just a modern-day minstrel show) there is a new all gay channel coming to cable. It’s called Logo and it should be coming to your area very soon. I can’t wait to get it!
